Flawian is provided by Mirabilia s. r. o., Brodská 6, 841 04 Bratislava, Slovakia, company identification number 47 518 316, registered in the Commercial Register of the Municipal Court Bratislava III, section Sro, file 94107/B ("Mirabilia", "Flawian", "we", "us").

2. Who may use Flawian
You must be at least 18 years old and legally able to enter into these Terms. Free and paid accounts are offered only for business use. You may use Flawian only for purposes relating to your trade, business, craft or profession, or as an authorized representative of an organization (a "Business Customer"). Flawian is not offered for personal, family or household use. Accounts are offered to Business Customers established in the EU/EEA or the United States.
3. Contract and account
When you create an account, you confirm that you are a Business Customer and accept these Terms. Before completing a paid checkout, you must repeat that confirmation and accept the then-current Terms and Refund Policy. We record the account, declaration, document versions, date and time of acceptance.
You must provide accurate account details, keep your credentials secure and notify us promptly of suspected unauthorized use. The display name and email address in your account must belong to you or be provided under your authority. Google sign-in may also be available.
4. The service
Flawian helps users develop a company profile, answer a structured wizard and receive decision-support material: a diagnosis of the business, prioritized recommendations and existing playbooks selected for the profile. The evaluation is performed by a rule-based, deterministic engine configured by Mirabilia. The same answers always produce the same result, and every result can be traced to the answers and rules that produced it. Features may change as the product develops, provided this does not remove a paid feature during a prepaid period without an appropriate remedy.
Flawian and its outputs are general informational decision support. They are not legal, tax, accounting, investment, medical or other regulated professional advice. They do not replace verification, professional judgment or advice suited to your circumstances. You remain responsible for your inputs, decisions and results.
5. Your content and feedback
You retain rights in information you submit. You give Mirabilia a non-exclusive licence to host, process and use it to provide, secure, improve and develop Flawian and to meet legal obligations.
Do not submit information about another person or special-category, highly sensitive, confidential or unlawfully obtained personal data. Flawian does not automatically detect every prohibited entry, so compliance remains your responsibility.
Account-linked ratings and optional feedback text are used to improve and develop the product. They will not be published as testimonials attributed to you without your permission.
6. Acceptable use
You must not:
- break the law or another person's rights;
- probe, bypass or disrupt security, access or usage limits;
- introduce malware, scrape at unreasonable scale, or reverse engineer except where applicable law expressly permits it;
- use the service or its output to deceive, discriminate, harass or cause harm;
- submit third-party or sensitive personal data contrary to section 5; or
- resell, sublicense or present Flawian output as regulated professional advice.
We may investigate suspected abuse and restrict or suspend access where reasonably necessary to protect users, the service or comply with law.
7. Our intellectual property
Mirabilia and its licensors own Flawian, its software, design, evaluation rules, playbooks and other service material, excluding your content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable right to use Flawian for your internal business purposes during your account or subscription.
8. Paid subscriptions and Paddle
Our order process is conducted by our online reseller Paddle.com, which acts as a third-party Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns, and processes payment, applicable taxes, invoices and billing administration under the checkout terms it presents. Mirabilia supplies Flawian and remains available at support@flawian.com for product issues.
Prices, billing interval and any applicable discount are shown before purchase. Subscriptions renew automatically until cancelled. You authorize Paddle to charge the payment method for each renewal. You may cancel through the available billing management flow; cancellation takes effect at the end of the current paid period, and access continues until then.
An upgrade takes effect immediately. The amount due is calculated by crediting the unused value of the lower plan against the higher plan according to the preview shown before confirmation. A downgrade changes recurring billing for the next period; the higher entitlement remains until the current paid period ends, and no refund or credit is created merely by scheduling the downgrade.
Refunds are governed by the Refund Policy at /refund-policy and Paddle's applicable buyer terms. Cancellation alone does not create a refund.
9. Emails
We may send service messages necessary for the account, security, purchases or legal notices. Marketing messages are sent only after your separate marketing consent, and each marketing email provides a way to unsubscribe. With that consent, messages may be tailored using the account email, company profile and use of Flawian.
10. Availability and support
We aim to keep Flawian available but do not promise uninterrupted or error-free operation. Maintenance, security events and providers outside our control may cause interruptions. Contact support@flawian.com for assistance.
11. Ending the service
You may stop using Flawian and delete your account through the available account controls. Export any information you need before deletion. A valid deletion request does not remove records that we must retain by law or need for limited legal claims, security or accounting purposes; the Privacy & Cookies Notice explains retention.
We may suspend or terminate an account for material or repeated breach, unlawful use, security risk or legal necessity. Where reasonable, we will give notice and an opportunity to cure. If we end a paid service without your breach, an appropriate pro-rata remedy will be arranged through Paddle.
12. Data access and switching
The account export allows you to retrieve available account and company-profile data in a structured, commonly used format. Subject to identity and authority verification, we will provide the access and reasonable switching assistance required by applicable law and will not impose prohibited commercial, technical, contractual or organizational obstacles. Export information you need before account deletion. Legal retention, security and backup rules may limit immediate deletion of narrowly retained records.
13. Third-party services
Flawian relies on providers including Paddle and Google. Their own terms may apply when you directly use their features. We are not responsible for an independent third-party service outside our control, but this does not exclude responsibility that applicable law places on Mirabilia.
14. Warranties and liability
To the extent permitted by law, Flawian is provided "as is" and "as available", without implied warranties of fitness, accuracy or uninterrupted availability.
For a Business Customer, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill or data. Mirabilia's total aggregate liability arising from a paid subscription is limited to the fees paid for that subscription in the 12 months before the event giving rise to the claim. For a free business account, the cap is EUR 100. These limits do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.
15. Changes
We may update these Terms for legal, security, provider or product changes. We will give reasonable advance notice of a material change through the service or by email. Continued use after the effective date means acceptance where permitted by law; if consent is legally required, we will request it.
16. Law and disputes
These Terms are governed by Slovak law. Disputes are subject to the courts competent for Mirabilia's registered office, unless mandatory law requires otherwise.
The supervisory authority for general Slovak e-commerce matters is the Slovak Trade Inspection, Central Inspectorate, Bajkalská 21/A, P.O. BOX 29, 827 99 Bratislava, Slovakia (www.soi.sk).
These Terms are provided in English, which is the contract language. Mandatory rights that cannot be waived remain applicable.
